ASSUMPTION ACADEMY CODE OF CONDUCT AND POLICIES

            Assumption Academy is a community of students, faculty and parents who come together in the Catholic faith to provide an educational experience grounded in the teachings of Christ and the expression of divergent views which allows the students and all members of the community to grow both in faith and as persons.  Assumption Academy is committed to educating the students and preparing them for high school and beyond.  In achieving this goal, this Code of Conduct was prepared by parents, teachers and administrators to reflect the ethics and values of the Assumption Academy community.

BELIEFS

"Where two or three are gathered in my name, then I am in the midst of them."

A spirit of Christ-like charity, respect for others, and mutual cooperation are essential elements of the learning environment at Assumption Academy.  Students are entitled to work and learn in an environment that encourages their academic, social and emotional development.  The school environment should be free from bullying, harassment and violence.  Students are to act with courtesy and respect toward one another and members of the faculty, staff and community.  They must take seriously their obligation to develop lifetime habits of self-control and concern for the well-being of others.  We hold students responsible for their actions, comments and attitudes. Students are expected to strive to behave in a manner consistent with the teachings of Christ. Similarly, students can expect that the parents, staff and faculty of Assumption Academy will act according to these same Christian tenets.

Student Rights & Responsibilities

"Blessed are the peacemakers, for they will be called the children of God."

Matthew 5:9.

            The following list of Student Rights and Responsibilities is not intended to be an exhaustive one, but is instead intended as an outline of what is to be expected, both of the students and by the students, of Assumption Academy.

Students should have the Right to the following:

•·        Participate in a school environment that is safe.

•·        Learn in an environment that is free from harassment or judgment.

•·        The respect of their peers and teachers.

•·        An educational program that is appropriate and challenging to their abilities.

•·        An educational environment that recognizes and supports their cognitive learning style.

•·        To express their opinions in a responsible manner.

•·        To know the rules and expectations of their behaviors.

Commensurate with these Rights, students shall have the following Responsibilities:

•·        Help maintain school property and maintain a safe school environment.

•·        Take responsibility for their behavior: actions, words and attitudes.

•·        Demonstrate respect for themselves through personal hygiene, dress and behavior.

•·        Demonstrate respect for others through the use of appropriate language, behavior and attitudes consistent with the teachings of Christ and the Catholic Church.

•·        Work to their potential in and out of the classroom, and  accept the challenges of their education, giving their best efforts to complete assignments in a timely and meaningful fashion.

•·        Speak up for themselves and be their own advocates in the classroom.

•·        Offer their opinions and actively participate in their education.

These rights and responsibilities go hand in hand with the behavior that is expected of the students.  Assumption Academy believes that the students will conduct themselves in a manner befitting of the standards of a Catholic School and the teachings of Christ.  There are certain behaviors that are expected while the students are representing their school, whether such behavior occurs on the school grounds or off the school grounds while the student is engaged in school related activities (i.e. sporting events at other schools; school trips; school social gatherings, etc.).

            By contrast, students will be disciplined for behavior that is not up to the standards set forth in this Code of Conduct.  A student who chooses to disrupt the good order of the school or to violate a policy or regulation will have to accept the consequences of those choices. Appropriate discipline is within the discretion of the Administration. Accountability for uncooperative, disruptive or unsafe behavior may take any of the following forms: misconduct referrals or warnings; extra assignments; denial of privileges; detention; in school suspension; out of school suspension; or expulsion.

The Code of Discipline will be set forth in more detail below.

The Code of Conduct for Assumption Academy exists to provide a safe environment conducive to the education and well being of the students and staff of Assumption. Students who choose to disregard the Code of Conduct can expect disciplinary sanctions commensurate with the conduct violation.

            The following are problem behaviors grouped by general severity of infraction. The list is not intended to be exhaustive or inclusive of all possible problematic behaviors, and the actual context and circumstances of any incident will determine its precise level of disciplinary severity. The final authority of interpreting and dispensing of disciplinary actions rests solely with the Administration of Assumption Academy.

Any action of an unlawful nature will result in notification of the appropriate Law Enforcement Agency. Any sanctions listed in the Code of Discipline are in addition to any actions taken by the appropriate Law Enforcement Agency.

Level I Infractions

      Automatic Detention, Possible Parent Meeting

      Detention slips will be distributed during the day by both teachers and lunch aides. They will be collected at the end of the day by Student Council members and recorded.

      Detention sessions will take place after school.  Parents will be notified in advance if their child will be staying after school and will need to sign and return a form.  If a student misses a detention session, s/he will need to serve two sessions to make up for the missed session.

      Any unserved detentions will result in loss of school privileges and those students will not receive their report cards.

      Level III Infractions

      **Involvement of Law Enforcement Personnel should be expected.

      Notes, Definitions, and Examples

                  It is to be understood that many of the above prescribed actions will be subject to a degree of interpretation. What is considered disruptive behavior or a "Classroom Disturbance" in an eighth grade classroom may be considered normal or typical behavior in a kindergarten classroom. Conversely, chewing gum is fairly uniform across ages and levels of maturity.

                  While not to attempt an exhaustive list of all those behaviors that would fall within the realm of disciplinary consequence, the following is intended to help clarify the intent of the above outline.


       

      Assumption Academy Dress Code Policy

      As a private school, Assumption Academy has a dress code. In sending your child to our school, you agree to abide by this code.  If students are not dressed in accordance with the Dress Code Policy, then it shall be considered a Level I infraction and discipline will follow as above.

      Assumption Academy Policy on Hand Held Electronic Devices

                 

                  The Administration at Assumption Academy understands that the students carry and bring to school certain hand held electronic devices (i.e. cell phones, ipods, computer games).  Such electronic devices shall be turned off and kept in students' backpacks during school hours unless permission has been granted to utilize such device.  If a student is caught using a hand held electronic device, such electronic device shall be confiscated and discipline will be assessed as set forth above.

      Policy on Bullying, Harassment and Hazing

      Bullying and/or harassment is any sort of continuing behavior that is annoying including inappropriate internet communication. It can be words, gestures and actions which tend to annoy, alarm, and abuse (verbally) another person. This includes behavior by a person where he or she: (1) makes a telephone call without purpose of legitimate communication; or (2) insults, taunts or challenges another in a manner likely to promote a disorderly response; or (3) makes repeated communications anonymously or at extremely inconvenient hours, or in offensive, coarse language;  or (4) subjects another to offensive touching; or (5) engages in any other course of alarming conduct serving no legitimate purpose of the actor.

      Harassment occurs then when one person makes repeated verbal, written or physical contact with another person who does not want these contacts. Bullying is a particular type of harassment that generally involves some force, whether overt or subtle. Exclusion is widely considered to be a form of bullying, even though there may be no apparent contact. By ignoring or excluding an individual from participation in some group activity, the bully demonstrates his or her force of power.

      Actions that violate the law, threaten or cause harm to other students or staff members, disrupt or impede the welfare and progress of the school community, or bring discredit to the school will not be tolerated. Such actions or other severe violations of school rules may result in immediate expulsion. If a student persists in violating basic obligations of courtesy, consideration, respect, cooperation or safety, a principal/parent/student conference will be scheduled.  If these cooperative efforts of parents and school staff prove ineffective, the student will be subject to expulsion or may be denied re-admittance to the school. Parents should be aware that some harassment might have legal consequences.

      Policy on Alcohol, Controlled Dangerous Substances and Tobacco

      DEFINITIONS

      Controlled Dangerous Substances are defined in sections l through V of the NJ Criminal Code.

      They include but are not limited to: marijuana, heroin and anabolic steroids.  The term controlled dangerous substance shall also include alcohol.

      Under the Influence:  A student is judged to be under the influence whenever s/he exhibits physical or physiological symptoms (including but not limited to unsteady walk, dilated pupils, slurred speech, erratic or uncharacteristic emotional reactions) which are commonly associated with the use of controlled dangerous substances.

      Possession is defined as knowingly or purposely obtaining or possessing, actively or constructively*, a controlled dangerous substance or drug paraphernalia:

      •a)      on or off school property;

      •b)      on the person;

      •c)      in an accessory (including but not limited to purse, book bag, gym bag or knapsack);

      •d)      in a locker or desk;

      •e)      in a privately or school-owned vehicle.

      (*Constructive possession refers to a student who intends or has the capacity to exercise control over the drug/paraphernalia even if she/he does not have physical possession of the item. For example, a student who hides drugs on school property or asks a classmate to hold drugs for him/her, constructively possesses the drugs.)

      Distribution is defined as sharing, selling or dispensing a controlled dangerous substance:

      •a)      on or off school property;

      •b)      with or without receiving payment;

      •c)      to individuals enrolled or not enrolled in the school.

      Possession with Intent to Distribute applies regardless of whether or not a student intended

      •a)      to receive payment;

      •b)      to distribute the controlled dangerous substance to an individual enrolled or not enrolled in the school;

      •c)      to distribute the controlled dangerous substance on or off school property.

      POLICY

      •1)      A student shall be considered in violation of school policy if she/he is observed

      •a)      to be under the influence;

      •b)      in possession;

      •c)      engaged in distribution; or

      •d)      have possession of a controlled dangerous substance.  

      •2)      Such a student shall be subject to the following provisions and to the general discipline policy stated in this Handbook.

      •a)      when a student is identified as being "under the influence" or "in possession" of a controlled dangerous substance, the principal will refer the matter to local law enforcement officials.

      •b)      When a student is identified as "distributing" or "in possession with intent to distribute" a controlled dangerous substance, the principal MUST refer the matter to local law enforcement officials.

      •3)      A student suspected of violating the policy governing controlled dangerous substances will immediately be placed under suspension for an indefinite period.  The student and parents/guardians shall be given a reasonable opportunity to respond to the allegation as quickly as possible.

      •4)      If the administration determines that there

      •a)      was no violation of policy, the student will be permitted to return to school.

      •b)      was a violation of policy, the principal will discipline the student according to the general discipline policy stated in this Handbook up to and including expulsion.

      •5)      The principal may require the student to participate in an appropriate treatment counseling program as a condition of the student's eventual return to the school.

      •6)      When violation of this policy involves "distribution" or "possession with intent to distribute," discipline imposed will normally be expulsion.

                 

      The role of "Mitigating Circumstances" and "Interpretation of the Rules."

                  It is anticipated that the above Violations of the Code of Discipline are expected to be applied universally to all students at all times. It is, however, further understood that in certain instances a mitigating circumstance or context issue may arise that requires a higher level of interpretation of the intent of the code beyond the simple letter of the code. For example, is the younger or smaller child who strikes an older or larger child in an act of perceived self defense guilty to the same degree as the older or larger child who strikes a younger or smaller child in an act of bullying? Is the child with a primary care giver suddenly and unexpectedly hospitalized to be held to the same standard of the Dress Code while being cared for by extended family or family friends? This is a matter of interpretation for some, and a simple matter or "yes or no" for others. In such circumstances it is left to the discretion of the Administrative Authority of the School to make such a determination. 

                  As to specific behaviors, it is hoped thatmembers of the Assumption Academy Community strive to conduct themselves in a manner consistent with the teachings of Christ.

      "Thou shalt love the Lord thy God with all thy heart, and with all thy soul, and with all thy mind.  This is the first and greatest commandment. And the second is like unto it, Thou shalt love thy neighbour as thyself. On these two commandments hang all the law and the prophets." (Matthew 22, 37-40)

                  In the spirit of developing and fostering these goals, the following Assumption Academy Pledge has been adopted. It is intended as a guideline for students and staff, to outline the expectations of appropriate behavior.
